1. INCORPORATION BY REFERENCE & MUTUAL ASSENT
BOTH PARTIES MUTUALLY AGREE that by accessing or using any feature related to Monty Pump Fund or the $MONTY token—including interactions that occur via the Pump platform—you are already bound by Pump's Terms of Use (including its class-action waiver, mandatory binding arbitration, risk warnings, non-advice, eligibility/prohibited-jurisdictions, and VPN/proxy prohibitions). BOTH PARTIES MUTUALLY AGREE you also accept equal or greater limitations, waivers, and risk allocations in favor of Monty Pump Fund as set out below. If you do not agree, do not use the project.
2. NO SECURITIES, NO ADVICE, NO OFFER
2.1 $MONTY is not a security, investment contract, hedge fund interest, note, or any regulated financial product.
2.2 Nothing herein constitutes a prospectus, offer document, solicitation, or recommendation to purchase or sell any asset in any jurisdiction.
2.3 No investment, financial, legal, tax, or brokerage advice is provided. You should obtain independent advice as needed.
3. ELIGIBILITY, PROHIBITED LOCATIONS & VPN BAN
3.1 You represent you meet all eligibility rules in Pump's Terms of Use, including age of majority and capacity to contract.
3.2 You will not access or use the project if you are located in, resident of, or otherwise subject to prohibited jurisdictions (including those listed by Pump and/or international sanctions regimes).
3.3 VPNs, proxies, IP masking, or any circumvention of geoblocking are prohibited.
3.4 You represent you are not a sanctioned person/entity and not a Politically Exposed Person (PEP), or otherwise restricted from participation.
4. NON-CUSTODIAL NATURE; USER CONTROL
4.1 All interactions are non-custodial. You retain control of your wallet(s) and private keys at all times.
4.2 Monty Pump Fund does not take possession of, or fiduciary responsibility for, your assets; no trustee, agent, or custodian relationship is created.
5. SMART-CONTRACT & TECHNOLOGY RISKS
5.1 All blockchain transactions are final and irreversible. Mis-sent funds and erroneous interactions cannot be recovered.
5.2 No smart-contract system is guaranteed secure; bugs, exploits, forks, reorgs, network congestion, MEV, oracle failures, and third-party outages may cause delays, errors, or total loss.
5.3 You accept full responsibility for device security, wallet hygiene, and private-key protection.
6. REWARDS: PROGRAMMATIC, DISCRETIONARY, NOT PROFITS
6.1 Any distributions or "rewards," if made, are purely programmatic and discretionary.
6.2 Rewards are not profits, dividends, interest, yields, or guaranteed returns and must not be relied upon as income.
6.3 Past distributions do not predict or imply future distributions.
7. AML/KYC, SANCTIONS, TAXES & COMPLIANCE
7.1 You are solely responsible for ensuring your participation complies with all applicable laws (including AML/KYC, sanctions, and tax).
7.2 Monty Pump Fund does not perform identity verification or provide compliance services on your behalf.
7.3 You are responsible for all taxes arising from your activities (acquisitions, transfers, staking, and any distributions).
8. ASSUMPTION OF RISK & CAPACITY TO BEAR LOSS
8.1 You confirm you have the technical understanding of blockchains, smart contracts, AMMs, staking mechanics, and their risks.
8.2 You confirm you have the financial capacity to bear a 100% loss without recourse to Monty Pump Fund or any associated person.
8.3 You acknowledge the project is experimental and may change, pause, or cease at any time without notice.
9. "AS-IS / AS-AVAILABLE"
9.1 The project is provided "AS-IS" and "AS-AVAILABLE," without warranties of any kind (express or implied), including merchantability, fitness for a particular purpose, non-infringement, accuracy, uptime, or error-free operation.
9.2 No service levels are promised; downtime, delays, and degraded performance may occur.
10. WAIVER OF CLAIMS; ALLOCATION OF RISK; SOLE REMEDY
10.1 BOTH PARTIES MUTUALLY AGREE to an allocation of risk under which, to the maximum extent permitted by law, all claims and remedies are waived and no liability of any kind is accepted by Monty Pump Fund, its operators, developers, contributors, or affiliates.
10.2 Where complete exclusion is not legally possible, BOTH PARTIES MUTUALLY AGREE that your sole and exclusive remedy is to stop using the project; no monetary recovery is available.
11. LIMITATION OF LIABILITY (MAXIMUM EXCLUSION)
11.1 To the maximum extent permitted by law, Monty Pump Fund and associated persons shall not be liable for any damages or losses of any type (including direct, indirect, special, incidental, consequential, exemplary, multiplied, or punitive), whether in contract, tort, statute, equity, or otherwise, arising from or related to your access or use of the project.
11.2 You waive any right to seek or obtain damages, specific performance, injunctive, or other equitable relief against Monty Pump Fund or associated persons.
12. ARBITRATION; NO COURTS; NO CLASS ACTIONS; TIME LIMIT
12.1 BOTH PARTIES MUTUALLY AGREE that any dispute shall be resolved only by individual, confidential, binding arbitration administered by a neutral arbitral forum selected for the matter.
12.2 No court proceedings, no jury trial, no class, collective, or representative actions are permitted. Consolidation or joinder of claims is not allowed without mutual consent.
12.3 Any claim must be filed within twelve (12) months of the event giving rise to it; otherwise it is permanently barred.
12.4 This Section operates in addition to Pump's arbitration/class-action provisions and, where stricter, controls.
13. USER REPRESENTATIONS & WARRANTIES
13.1 You represent and warrant, now and continuously, that:
a) you understand and accept these Terms and Pump's Terms of Use;
b) all actions you take are based on your own judgment and due diligence;
c) you are not relying on Monty Pump Fund for advice or fiduciary duties;
d) all information you provide is true, complete, and current;
e) you have obtained and will maintain all approvals/consents necessary for your participation.
14. PROHIBITED CONDUCT
You agree not to: (a) violate these Terms or Pump's Terms; (b) circumvent geoblocks via VPN/proxy; (c) manipulate markets or conduct fraud; (d) reverse-engineer, attack, or attempt unauthorized access; (e) infringe IP rights; (f) upload malware; (g) use bots or scraping in violation of applicable rules; (h) engage in any activity that would cause Monty Pump Fund or others to violate law.
15. MODIFICATIONS, SUSPENSION, TERMINATION
15.1 Monty Pump Fund may modify, suspend, or discontinue any aspect of the project at any time, without notice or liability.
15.2 These Terms may be updated at any time; continued use constitutes acceptance.
15.3 Sections intended to survive (including 2–12, 15–18) survive any termination or cessation.
16. INTELLECTUAL PROPERTY
16.1 Monty Pump Fund and licensors own all rights, title, and interest in the project's code, design, branding, and content.
16.2 You receive a limited, revocable, non-transferable license to access and use the project for personal, lawful purposes.
16.3 You may not reverse-engineer, copy, sublicense, or exploit any portion of the project except as expressly permitted.
17. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless Monty Pump Fund and associated persons from all claims, losses, liabilities, damages, costs, and expenses (including legal fees) arising out of or related to: (a) your use of the project; (b) your breach of these Terms or Pump's Terms; (c) your violation of law or third-party rights; (d) your wallet/device security failures.
18. ENTIRE AGREEMENT; SEVERABILITY; NO WAIVER
18.1 These Terms, together with Pump's Terms of Use (incorporated by reference), constitute the entire agreement regarding your use of the project.
18.2 If any provision is held invalid or unenforceable, the remainder remains in full force and effect.
18.3 No failure or delay to enforce any provision constitutes a waiver of that or any other provision.
19. PLAIN-LANGUAGE SUMMARY (NON-CONTRACTUAL)
- Not a security or investment. No advice, no promises, no profits.
- You bear all risk. Transactions are final; you can lose everything.
- No liability, no claims. Your only remedy is to stop using it.
- Arbitration only. No courts, no juries, no class actions.
- Pump's Terms apply—and our stricter rules win.
BOTH PARTIES MUTUALLY AGREE that by continuing to access or use Monty Pump Fund or $MONTY, you give informed, voluntary, and irrevocable consent to these Terms and to being bound by the stricter of (A) Pump's Terms of Use and (B) this document.
